Submission of the Claim Application in due course is a major prerequisite for the Guarantee Holder’s right to indemnity and consideration of the Application. Compliance with the Guarantee Agreement and the General Contractual Terms ensures the Guarantee Holder the receipt of the indemnification. There are also other conditions set for the Guarantee Holder such as the duty to inform of the increased risk of loss and risk of default on the payment.
If the risk of loss has increased the Guarantee holder shall contact Finnvera plc without delay in order to start the precautionary measures or discuss the measures to be taken in order to minimize and limit the losses and to receive the best possible outcome.
If the recovery proceedings have to be started immediately the Guarantee Holder can start them without first discussing them with Finnvera plc unless the transaction is a large structured financing deal or the recovery proceedings are expected to be high or the planned proceedings include a realization of the security.
When applying for the indemnification the Guarantee Holder has to give Finnvera all the information, documents and other necessary clarifications which can reasonably be acquired by the Guarantee Holder.
After paying the indemnification the Guarantee Holder shall transfer all the documents and rights to Finnvera plc if Finnvera so requests.
